URGENT ADVICE NEEDED – Step by Step Please
My name is Anita. I was born in U.S.A, lived there for 8 years, then moved to Canada. I’ve been in Canada since, am a Canadian citizen, and got married over a year ago. My husband, is also a Canadian citizen. We are both in our early 20s and are planning on moving to U.S.A for future career opportunities. I have a few relatives in the U.S. and what we’ve heard so far is that I can move to U.S. and live there, but because my husband doesn’t have any such status, he can stay with me as a visitor for a maximum of 6 months, then he’ll have to re-enter U.S.A…. Which is not a problem for us, as we both have family in Canada that we can visit every 6 months until he gets his permanent residency.
The question now is, can we file the I-130 petition for alien relative whilst residing in Canada, or will it be quicker/better if we first move to U.S.A and then file it? What are the things I have to show/have (either in Canada or U.S.A) in order to be able to file for my husband’s U.S. immigration? What can either of us do while residing in the U.S. until he gets his PR (e.g. work, job, studies), and approximately how long does it take before getting PR and then citizenship?
He’s currently doing his Masters online from a Canadian university, so there’s no problem in being able to continue that from U.S. which is why we would rather move now rather than later (when he would want to find a place for his practicum for Masters in Public Health and later on find a job).
My U.S. passport is expired. Not sure, what other details, documents are needed. Any guidance would be appreciated.
